New notices for old problems?

Can you paint your house yellow? Maybe, maybe not. However, if you did happen to paint your house yellow last year, can your landlord come back to you now and complain about it?

Well, they can, but they can’t evict you for it. Oregon law makes it clear that if your management is aware a condition exists and accepts rent over a period of three consecutive months, without giving you notice, then they have waived their right to terminate your tenancy over that particular violation.

This does not apply to maintaining your space, deterioration of your home or health and safety hazards of course.

So maybe you can’t paint your house yellow, but if it’s been yellow for three months or more, then you can keep your yellow house (if you really want to.)
